So that we may better manage your expectations, we have developed the following terms and conditions to govern your purchase from Captain Dave Inc.

Terms and Conditions

By clicking on “submit this order” and placing your order through this web site, you, the customer, are stating that you have read and understand the following Captain Dave Inc. terms, conditions and policies:

Payment

  • All payments are due when the order is placed. Captain Dave Inc. accepts payments via Visa, MasterCard, American Express and Discover cards billed to U.S. or Canadian addresses.
  • Customers with billing addresses outside the U.S. and Canada should contact Captain Dave to arrange payment.
  • All credit card orders are address-verified; failure to provide an accurate billing address will result in a fraud alert and your order will be significantly delayed or canceled. In the event of a fraud alert, we will make an attempt to contact you via e-mail and/or phone.
  • We usually will not charge your credit card until the item is ready to ship. Special orders or custom orders are an exception and may be billed when we receive the order. All clothing items size 4XL and larger and all orders of more than 4 of an identical item are considered special orders.
  • High-volume government and institutional buyers wishing to use purchase orders or to pay via check should first contact Captain Dave Inc. to arrange terms.

Shipping

  • Two-day and next-day orders received by 6 p.m. usually ship out the next business day. All other items usually ship in one to four business days, although Ready Reserve food may take longer. Three Day UPS orders may get to you sooner, but do not ship sooner than UPS Ground.
  • Due to delivery times, UPS Ground orders and U.S. flat-rate orders may take from three days to two weeks to reach you. UPS Select 3 Day will be faster for West Coast destinations.
  • You should receive an automated UPS notification email when your item ships, and it will include an anticipated delivery date. In our experience, these dates are accurate about 90 percent of the time.  However, we can't be responsible for weather or other service interruptions that delay delivery.
  • APO/FPO orders are welcome. Please select "U.S. Shipping" for shipping to APO/FPO addresses.
  • U.S. shipping is ONLY available to APO/FPO and the 48 continental U.S. states. Hawaii and Alaska customers will be charged a delivery surcharge if they select this rate. International customers must select the appropriate air mail category. We reserve the right to change shipping categories and shipping costs if a customer selects the wrong one. For example, a customer in France who selects “Air Mail to Canada” will be charged the “Air Mail to Europe” rate.
  • If your shipping cost is zero or your preferred shipping option has disappeared, your order is too heavy for our system or for that shipping type -- please select another shipping method or we can send you a quote.
  • Most domestic orders ship UPS or Priority Mail. Unless you specifically select UPS shipping, we reserve the right to use priority mail, express mail or other carriers and will do so for small items as well as orders to APO/FPO, Hawaii, Alaska, Puerto Rico, Guam and the U.S. Virgin Islands. Large orders will ship via truck.
  • Except as outlined above, if the shipping charge is not sufficient to cover costs of delivery, we will contact you.
  • Captain Dave makes every effort to meet our target delivery dates but these times are not guaranteed. Depending on the policy of the carrier, you may be eligible for a refund for a portion of your shipping costs should your two-day or next-day item be delayed.
  • It is the customer’s responsibility to provide an accurate delivery address. If you provided an inaccurate address or your package is refused or returned for any reason, we will not refund the shipping costs. If you want us to re-ship your item, you will be charged shipping costs a second time. If you do not want your item re-shipped, we will treat it as a return.
  • UPS charges $5 to correct an address. We reserve the right to pass this cost on to customers who require address correction.
  • We reserve the right to send packages "signature required," and will often do so for addresses in apartment buildings and for high dollar value items. This is for your safety, as we want to make sure you get your goods. 
  • Once your package is in the hands of UPS, USPS or another carrier, they are responsible for any damage, loss or non-delivery or miss-delivery issues. We will gladly work with you and the carrier to help you sort out any problem, to facilitate delivery, or to file an insurance claim, but once it is in the carriers hands, it's out of ours and we can no longer be responsible for your item. We do offer shipping insurance through third parties.
  • The quality and timeliness of Postal Services deliveries in other countries varies. As a result, orders sent to addresses outside the United States via Air Mail are sent at the customer’s risk.  International customers, please note that we will provide proof of mailing as generated by our mailing software, but we cannot be responsible for address mistakes, delays or non-delivery of international mail. 
  • Customers are responsible for customs duties, local taxes, tariff and other fees required for delivery beyond the actual shipping cost. Please note that UPS and other carriers may charge fees for customs clearance.  These fees are your responsibility
  • We will not lie or reduce the cost on the pro-forma invoice to save you customs duties. We will not check “Gift” for an item that is a purchase.

Privacy Policy

  • This policy covers how Captain Dave Inc (CDI) treats personal information that CDI collects and receives. Personal information is information about you that is personally identifiable like your name, address, email address, credit card number, or phone number, and that is not otherwise publicly available.
  • This policy applies only to the practices of companies that CDI owns or controls, or to people that CDI employs or manages.

Information Collection and Use

  • CDI collects personal information when you register with CDI, when you sign the guest book or purchase items from us.
  • CDI may automatically receive and record information on our server logs from your browser, including your IP address, cookie information, and the page you request.
  • CDI uses this information to fulfill your requests for products and services, make your shopping experience faster and easier, provide newsletters, improve our services, contact you, conduct research, and provide anonymous reporting for internal purposes.
  • This site is not intended for use by children under age 13 and children under age 13 should not register or make purchases without parental consent.

Information Sharing and Disclosure

  • CDI does not rent, sell, or share personal information about you with other people or nonaffiliated companies except to provide products or services you've requested, or as required by law.
Cookies
  • Depending on the web site pages you visit, CDI may set and access cookies on your computer. For example, cookies are required to use our shopping cart and to retain the contents of the cart should you leave the site and return later.
  • CDI may let other companies that show advertisements on some of our pages set and access their cookies on your computer. Other companies' use of their cookies is subject to their own privacy policies, not this one. Advertisers or other companies do not have access to CDI's cookies.

Your Ability to Edit and Delete Your Account Information and Preferences

  • Once you have registered, you can edit your personal information at any time.
  • You can delete your CDI account by e-mailing us a request to do so.
  • We reserve the right to send you certain communications relating to the CDI service, such as service announcements, administrative messages and the CDI Newsletter, that are considered part of your CDI account, without offering you the opportunity to opt-out of receiving them.

Confidentiality and Security

  • We limit access to personal information about you to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs.
  • We have physical, electronic, and procedural safeguards to protect personal information about you.

Changes to this Privacy Policy

  • CDI may update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your CDI account or by placing a prominent notice on our site.

Warrantees

Some items sold by Captain Dave Inc. have a manufacturers warranty. All others are sold as is, with no other warranties, whether express or implied, including any warranty of merchantability or fitness for a particular purpose. Captain Dave Inc. specifically disclaims any responsibility or liability for incidental or consequential damages

 

Disclaimers  

  • When we say things like “military style,” or “similar to those used by our troops,” we are not claiming these are identical to military issue items or are Mil-Spec. Items that our suppliers tell us are used by the government, meet military or federal specifications, are made by military or government contractors will say so in the item description. If you want the real thing, look for words like “genuine” and “government issue.”
  • The FTC Act requires that health- and safety-related claims, such as claims that a gas mask, regulator or protective clothing can protect against contaminants, including nuclear, biological and chemical contaminants, must be supported by competent and reliable scientific evidence. Captain Dave Inc makes no claims as to the effectiveness of any of the gas masks, respirators, water filters or protective clothing it sells, however the manufacturers do claim the effectiveness of the protection their products offer. Any claims that an item is suitable for a specific use, or that an item meets or exceeds military, EPA or other standards is based on the manufacturer or distributor's claim to us. We have no means to scientifically prove or disprove such claims.
